The state’s tribal-only framework puts the four federally recognized Wabanaki nations at the center of its iGaming industry, while a legal challenge from a commercial casino operator could test the limits of that approach.

The launch remains provisional. Written comments on the latest draft regulations are due October 30, after which the rules could face a legal review lasting up to 120 days. Further amendments could push the opening date back again.

Tribal Partnerships Could Determine Which Brands Enter Maine

Maine became the eighth US state to legalize online casino gambling when legislation took effect without Governor Janet Mills’ signature in January 2026. Under the law, online casino operating rights are reserved for the state’s four federally recognized tribal nations.

Three have expanded their existing sports betting partnerships with Caesars Entertainment to include online casino gambling: the Houlton Band of Maliseet Indians, the Mi’kmaq Nation and the Penobscot Nation. The Passamaquoddy Tribe, which works with DraftKings for sports betting, has yet to announce an iGaming agreement.

That gives Caesars a potential head start in building its online casino presence in Maine, although final participation will depend on licensing and regulatory approval. The structure also makes tribal partnerships the gateway to a market that commercial casino operators cannot enter independently under the current law.

Player Protection and Licensing Still Need Work

The proposed rules cover player accounts, game certification, advertising and responsible gambling. Customers would have to be at least 21 and physically located in Maine to wager. Operators would need to segregate customer funds, provide account activity and loss information, and prohibit credit-card deposits.

An automated universal self-exclusion system would allow operators to receive updates as exclusion records are added or removed. Advertising aimed at under-21s would be prohibited, and promotional materials would have to identify the beneficiary tribe prominently.

The draft proposes an 18% tax on adjusted gross revenue, with no deductions for bonuses or free-play promotions. Operators would pay a proposed $50,000 licensing fee. Meanwhile, the Gambling Control Unit is hiring six staff members and building the portal needed to process applications.

Commercial Casinos Challenge the Move

Churchill Downs Inc., owner of Oxford Casino Hotel, is challenging Maine’s law, arguing that it creates a “race-based monopoly” by excluding the state’s two commercial casinos from online gambling. The Wabanaki nations were added as defendants in April, and the dispute could have implications for how tribal gaming rights interact with state-regulated online markets.

The case does not necessarily have to be resolved before Maine launches, but a later ruling could disrupt the market’s operating model. That uncertainty makes the rollout relevant to more than local players: other states considering online casino expansion will be watching how Maine balances tribal rights, commercial competition and regulatory oversight.

That said, Maine’s defining challenge may be less about getting online casinos live than proving that a tribal-led model can deliver a sustainable market while withstanding a legal challenge over access. The outcome could influence how other jurisdictions approach the next phase of US iGaming expansion.

Maine’s planned online casino market could open in early 2027, but the bigger story is who gets to compete.
